Family law has an entire"section" devoted to child custody, and the legal issues are meant to be tackled by a family lawyer who has the necessary skills and experience to deal with them. When the divorce took place between men and women then it also creates problems to the children associated with them. When separation process began and family issues settled between two partners then the most important issue arises is the protection of the best rights of their children. Since the future of the child is at stake, much discussion should be made when it comes to his or her living conditions and the pattern he is used to. After all, remember that the child's best interests are what should be prioritized.

Some parents who divorce opt to put off the decision-making as to the custody of their child in order to make sure they avoid creating a scene or making things worse between and among them. Temporary custody and child support could be readily obtained by filing a case with the family court. This is in case the separation was too sudden and one parent left home abruptly. If the process is delayed and one parent considers that the other parent is taking away the kid without the parent's knowledge or consent. It is the child's best interests that should be take note of. This is where the family law judge in a family court would come in, making decisions that would inure to the benefit of the child.

As a result, child custody of children this age is often given to the mothers. However, in most states in the US, this is not really followed very much once divorce takes place between parents. The tender years may be said to be ideally spent with the mother. However, should the parents have reached an agreement as to the custody of the child, the agreement would have to be followed instead.
